1. About These Terms

These Terms and Conditions govern your use of the AuctionBargain website and marketplace (auctionbargain.au), operated by Confidia Limited (ABN 65 641 060 782), a private Australian company with its registered office at Unit B1, 13-21 Mandible Street, Alexandria NSW 2015, Australia.

By accessing or using AuctionBargain, you agree to be bound by these terms. If you do not agree, please do not use our platform.

2. Definitions

  • "Platform" — The AuctionBargain website at auctionbargain.au
  • "Seller" — A user who lists items for auction or sale
  • "Buyer" or "Bidder" — A user who bids on or purchases items
  • "We", "Us", "Our" — Confidia Limited, operator of AuctionBargain

3. Account Registration

To use AuctionBargain, you must:

  • Be at least 18 years of age
  • Provide accurate and complete registration information
  • Maintain the confidentiality of your account credentials
  • Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that violate these terms.

4. Buying & Bidding

When you place a bid or purchase an item on AuctionBargain:

  • You enter into a legally binding contract with the seller if your bid is successful
  • You agree to pay the full amount (including any shipping costs) within the specified timeframe
  • You acknowledge that AuctionBargain is a marketplace platform and is not a party to the transaction between buyer and seller
  • Bids cannot be retracted except in limited circumstances as permitted by law

5. Selling on AuctionBargain

When you list an item for sale:

  • You warrant that you have the legal right to sell the item
  • You must describe the item accurately and honestly
  • You must not list prohibited items (including illegal goods, counterfeit products, weapons, or items restricted by Australian law)
  • You are responsible for collecting and remitting any applicable taxes (including GST)
  • You agree to deliver the item as described within the stated timeframe

6. Fees & Payments

All payments on AuctionBargain are processed through HowToPay, Confidia Limited's proprietary Australian payments platform. Fees and charges are displayed at the time of listing or checkout.

All prices are listed in Australian Dollars (AUD) and include GST where applicable.

7. Intellectual Property

The AuctionBargain name, logo, website design, and platform technology are the intellectual property of Confidia Limited. You may not copy, reproduce, or use them without our express written permission.

8. Limitation of Liability

To the fullest extent permitted by Australian law, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010):

  • AuctionBargain is a marketplace platform and is not responsible for the quality, safety, or legality of items listed by sellers
  • We do not guarantee the accuracy of listings or the ability of sellers to complete transactions
  • Our liability is limited to the fees paid by you for the use of our platform
  • Nothing in these terms excludes or limits your rights under the Australian Consumer Law where those rights cannot be excluded by contract

9. Dispute Resolution

If you have a dispute with a seller or buyer:

  1. Contact the other party directly through the AuctionBargain messaging system
  2. If unresolved, contact us at [email protected]
  3. We will attempt to facilitate a resolution within 14 business days

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or through the platform. Continued use after changes constitutes acceptance.
